Liability Waiver
Nicole Perry and her family, acquaintances, or any other person acting on her behalf (herein referred to as “Agents”), makes no guarantees of performance on the part of Client or animal as a result of providing animal behaviour consultation and/or training. Client agrees that Nicole Perry and Agents will not be held liable for any damage or loss resulting from failure of the animal to respond to any signals, commands, or cues taught to the animal by Nicole Perry or Agents or resulting from counselling and advice supplied to owner of dog.
Client acknowledges that training and applied behaviour analysis may be an activity in which damage or injury to dog(s), animals and/or persons may occur. Client will assume full financial and moral responsibility for the actions of his/her dog(s). Client further acknowledges that dog(s) or animals may be exposed to a variety of environmental conditions which include, but are not limited to, vehicular travel, interaction with people and other animals, exposure to adverse weather, and exposure to areas with crowds and all types of traffic.
Client agrees that he/she, his/her heirs, assignees and legal representatives will not make claim against, sue, or attach the property of Nicole Perry or Agents for injury or damage done to or by dog(s) resulting from action or negligence, however caused, by Nicole Perry or Agents. Client forever releases Nicole Perry and Agents from any and all liability and demands which Client, his/her heirs, assignees and legal representatives may have or may hereafter have for injury or damage to or by animals or dog(s), and assume all risks thereof.
To better protect you and your privacy, we provide this notice to explain our on and offline information practices and the choices you can make about the way your information is stored, collected and used. Our policy notice applies to all information collected or submitted using our products and services.
We use return e-mail addresses to answer any e-mails we receive. These addresses are not usually used for any other purpose and are not shared with third parties except when such return addresses appear in e-mail text that is forwarded to a third party in the normal course of responding to that e-mail or if we require to do so as part of the natural course of events.
For subscribers to our email lists, we will not sell, make available or in any way distribute your e-mail address to anyone else, furthermore, we will not send you e-mails other than for the purpose of the e-mail subscriber list for which you are subscribing.
We automatically subscribe users to any of our products, both paid and free, to our newsletter. Users can unsubscribe at any time, we ask you to do so via email with a subject line “unsubscribe” and request that you do so in a polite courteous manner so we can extend the positivity of our services across to humans too.
We use reasonable precautions to protect the privacy and security of all user information and any other information that is stored or transmitted using our products and/or services. Our web services are hosted by reputable third party hosting services. While the experience with our hosting services has been very good, we make no representation or warranty with respect to backing up, disaster recovery, or data security.
Specifically, we don’t offer the ability to selectively restore content items that are stored or transmitted using our products or services, nor do we provide guarantees that some and or, all of the data content you store or transmit using our services will not be permanently lost or corrupted. You are solely responsible for maintaining backup copies of any data that you deem important.
We may use, or make available for you to use, secure connections to encrypt information flowing though our products and services. When and if, such connections are available, we encourage, but do not require, you to make use of them.

Miscellaneous
Client agrees that any pictures, audio or video taken by Nicole Perry or Agents of any private training session, group class or any other activity sponsored by Nicole Perry is the property of Nicole Perry and can be used for marketing, promotion and training purposes by said party. Further, Nicole Perry will retain exclusive and perpetual worldwide rights to such content.
Client agrees that their email address will be subscribed to Nicole Perry Email Newsletter.
By subscribing to any of our services you are agree to these terms of service, Client agrees that any other people who attend Nicole Perry sessions, any third parties, representatives etc, whether in person or online, with or on behalf of the Client will be bound by the terms of this agreement.
Client and Nicole Perry hereby agree to mediate and/or arbitrate any misunderstanding that may arise pursuant to the terms contained herein. In any action or proceeding arising out of this agreement, the prevailing party shall be entitled to reimbursement of costs and legal fees.
This terms of service supersedes all other agreements, written or oral, previously made between Client and Nicole Perry.
